According to the San Francisco Examiner's Mike Aldax, Brooks used a beer bottle to bash Divens on the head thrice and then punched him while Brooks was in a drunken stupor in his San Jose residence last month.
Aldax reports two other teammates, who were unnamed, were witnesses to the incident which occurred at on June 8 at 2 a.m. at Brooks' five-bedroom home. Their night out included a trip to San Jose's Club Agenda. At one point, Divens was said to have told Brooks "to get home to his kids" which set off some playful trash talking.
Divens then drove Brooks' truck on the way to the outside linebacker's home as he was "very intoxicated." At one point, Divens jokingly pretended to throw Brooks' car keys onto the grass when he asked for them. That was when the alleged beer bottle bashing incident took place, per Aldax.
NFL.com's Gregg Rosenthal writes Divens initially wanted to press charges, but he had a change of heart five days afterward. This was indicated in court documents obtained by the San Jose Mercury News.
Prosecutors turned in an application for an arrest warrant on a felony assault charge with great bodily injury to Judge Sharon Chatman, which she signed, the case was put on hold a day later, per Rosenthal.
The San Francisco Examiner maintains Divens "had a 3-inch laceration on the left side of his forehead, and blood covered his shirt and spilled in his car, according to police."
Prior to the shelving of the arrest warrant, the San Francisco 49ers organization released a statement about the incident.
"We are aware of the situation involving Ahmad Brooks. Out of respect for the legal process, the club will have no further comment at this time."
Brooks amassed 24.5 sacks over a four-year span. In the last 32 regular season games, he has 96 tackles, 13.5 sacks and returned an interception 50 yards for a touchdown.
