NFL: SF 49ers QB Colin Kaepernick Investigated for Sexual Misconduct

San Francisco 49ers quarterback Colin Kaepernick and two other football players are being investigated for possible sexual misconduct in a Miami Hotel which occurred last week.

NFL: SF 49ers QB Colin Kaepernick Investigated for Sexual Misconduct

San Francisco 49ers quarterback Colin Kaepernick is being investigated for possible sexual misconduct. 

According to TMZ, Kaepernick, 49ers wide receiver Quinton Patton and Seattle Seahawks wide receiver Ricardo Lockette were all involved, citing a police report: 

"TMZ Sports has obtained a police report filed after the alleged incident...in which the accuser claims the alleged incident took place at a residence at the Viceroy Hotel on April 1. 

"According to the report, issued by the Miami PD, the woman claims she went to the apartment of Seattle Seahawks wide receiver Ricardo Lockette...to hang out with him, Kaepernick and 49ers wide receiver Quinton Patton.

"The woman told police, around 9 pm that night she mixed some drinks for the guys and gave them shots, but they told her that 'in order to drink the shots she had to 'hit' the bong which contained marijuana.' 

"The woman says she felt lightheaded and went to the bedroom to lie down. She claims Kaepernick 'came up behind her into the bedroom and started kissing her.'

"She advised they were kissing (mouth) and Mr. Kaepernick started to undress her. She got completely naked. Mr. Kaepnernick told her that he was going to be right back and left the bedroom. They did not have sex.

"The woman told cops that while she was still naked in bed, Patton and Lockette opened the door and 'peeked' inside. She says she told them to get out...but she can't remember anything after that. 

"The woman later woke up in a hospital bed...but says she doesn't remember how she got there or who took her there. 

"The woman also claims she has had a sexual relationship with Kaepernick in the past."

ESPN confirms there were no arrests made and charges filed. 

The Miami Herald's Charles Rabin reports the woman took a rape test but the results weren't divulged to the public. He states Kaepernick hinted via a tweet last week that he was in town for a friend's wedding. 

Rabin then goes into greater detail about the apartment where the alleged incident took place. 

"Though the woman told police that Lockette lived in the apartment, Miami-Dade county records indicate the two-bedroom, two-bathroom, 1,347 square-foot apartment is owned by Jose Sabioni de Lima, who could not be reached Thursday for comment.

"The apartment is one of downtown's most iconic structures along the Miami River was last purchased in July 2012 for $650,000." 

Rabin also adds Kaepernick becomes the second high-profile NFL player whose name has been linked to alleged sexual misconduct in Miami-Dade County following that of Darren Sharper, who was allegedly involved in a sexual assault case which happened two years ago.

The woman seems to also have a past with Sharper, per The Miami Herald report. 

"The woman told police she came forward 'to clear her conscience' after learning Sharper had been suspected of at least six rapes in five states. The woman said Sharper drove her to a South Pointe condo where she passed out, then woke up in the morning and saw Sharper quickly putting on his pants and telling her they didn't have sex." 

The 49ers issued a statement on the Kaepernick incident, courtesy of SFGate.com's Ann Killion. It reads,"The 49ers organization is aware of the recent media report regarding Coiln Kaepernick and is in the process of gathering the pertinent facts."

Kaepernick is entering his fourth NFL season with career totals of 5,046 passing yards, 31 touchdowns and 11 interceptions with a 93.8 passer rating, per ESPN stats
